1. Defendant HULDA CLARK, an individual, is an unlicensed naturopath who resides in California and operates a clinic in California and Mexico. She claims that all cancers and many other diseases are caused by "parasites, toxins, and pollutants" and can be cured within a few days by administering a low-voltage electric current, herbs, and other nonstandard modalities.

(a) Provides news and other information about Hulda Clark and her activities, including the publication of libelous statements involving this lawsuit.

(f) Solicited funds to subsidize the defense when Hulda Clark was prosecuted for practicing medicine without a license in Indiana, as noted in paragraph #16, below.

8. Defendants TIM BOLEN and JAN BOLEN, individually, Jurimed, both individually and on behalf of DR. CLARK RESEARCH ASSOCIATION, HULDA CLARK, DAVID P. AMREIN and ILENA ROSENTHAL and Does 1 thru 100, wrote numerous letters, articles, messages, and/or published these letters, articles and messages, on the internet and sent to numerous individuals starting on or about November 7, 1999.

The writings and publications were performed by or on behalf of Defendants TIM BOLEN, JAN BOLEN, JURIMED, DR. CLARK RESEARCH ASSOCIATION, HULDA CLARK, DAVID P. AMREIN and ILENA ROSENTHAL, all of whom do business in the State of California, and Does 1 to 100 (hereinafter referred to collectively as "Defendant Publishers" or "Defendants.")

One of his clients is a former patient of Hulda Clark who is suing Dr. Clark for fraud.

16. In September 1999, Hulda Clark was arrested in California, based on a fugitive warrant from Indiana, where she faced charges of practicing medicine without a license. The case originated in 1993 when Dr. Clark lived and practiced in Indiana. Government documents and press reports indicate that after a former patient complained to the Indiana attorney general, a health department official, accompanied by a deputy attorney general, visited her office and was diagnosed with AIDS and sent to a laboratory for a blood test. Dr. Clark -- apparently tipped off by the lab -- found out she was being investigated and left Indiana a few days later. In 1999, she was apprehended in California and returned to Indiana to stand trial. In April 2000, an Indiana judge dismissed the charges on grounds that too much time had elapsed between the filing of the charges and Dr. Clark's arrest.

(f) He filed a false complaint against Hulda Clark with the FBI in San Diego.

55. On information and belief, Defendant Hulda Clark is using and promoting the use of diagnostic devices and treatment methods that lack FDA approval and would not be legal to market for their intended purposes within the State of California or in interstate commerce.

57. On information and belief, Defendant Dr. Clark Research Association, through its Web site and other channels, is promoting and marketing books written by Hulda Clark and promoting and collecting payment for Dr. Clark's services in Mexico. Information about this commercial activity is incorporated herein as Exhibit "15."

The Bizarre Claims of Hulda Clark

After Clark's arrest, Geoffrey Clark set up a defense fund to pay for expenses associated with defending her against "legal attacks." A description of the fund states that the covered expenses would include attorney fees, publicists, expert witnesses, court costs, and appeals and that Goeffrey would administer the money without compensation. The report also stated that by May 31, 2000, the fund had raised $113,943.76, earned interest of $665.96, and spent $27,900.51 for legal expense, $327.65 for "Acct/Copies," $56,408.43 for public relations, and $714.30 for Hulda Clark's travel. It did not indicate how much of the public relations payment went to the Bolens. This information was published on the Web site of New Century Press, which Clark owned and used to publish her books until a few months before her death.

The FTC's case was supported by three lengthy affidavits that dissected and thoroughly debunked Hulda Clark's theories and treatments. Among other things:

2. On May 11, 1993, at approximately 1:00 p.m., Karl Milhon, an investigator for the Indiana Department of Health, Acquired Diseases Division, and I entered the premises of Hulda Clark, Ph.D., Coffey Lane, Nashville, IN 47448.

7. The following are statements made by Hulda Clark to us during our appointment concerning her treatment of HIV positive patients. During this appointment, she tested Karl for cancer and the HIV virus an the machine described above. She told him he had the HIV virus, but said that he did not have cancer.

7. I became aware of Hulda Clark's claims regarding parasites and disease in 1996 when I developed my web site. As part of developing this web site, I conducted extensive searches of the web for other parasitology sites. In addition to sites that were clearly academic and instructional in content, I came across many sites that espoused the belief of Hulda Clark that parasites cause many diseases including cancer, AIDS, Alzheimer's disease, diabetes, etc. Throughout my 33 years in academia, I had never heard of nor read about such a theory. Initially, I simply ignored Hulda Clark and her theory, as I was simply too busy. However, as my web site developed, I began to get e-mails asking for my "opinion" about Clark and her theories. I also discovered that many of the "proClark" web sites had copied copyrighted images from my web site and were using them without my permission. Thus, I not only purchased Clark's books, The Cure for All Cancers (1993), The Cure for HIV and AIDS (1993), and The Cure for.All Diseases

(1995), but I also began an extensive search for and investigation of "pro-Clark" web sites. Over the past few years, I have become familiar with Hulda Clark's theories and many of the web sites that support her theories and sell various cures for parasites.

The claims of Hulda Clark (and many of the web sites that sell herbal remedies and "Zapper") that (1) a single parasite causes cancer, AIDS, and many other diseases, and that this parasite can be killed with electrical devices ("Zappers") are not supported by competent and reliable scientific evidence.

18. In response to the appearance of this statement, I received several e-mail messages from David Amrein, the President of the "Dr. Clark Research Association." Mr. Amrein asked that I remove this statement from my web site, and, in hopes of finding supporting information, I responded with the following: "Tell me where I can find information that supports the theories of Hulda Clark, information that has been published in peer-reviewed journals, and I will remove the comments from my web page. In fact, if you tell me where I can find this information, I will be more than happy to (1) include the information in my web page and (2) add an apology to my web page. I await anxiously your response." Despite my very clear request for information, Mr. Amrein did not provide any information that would support Clark's theories.

19. Later in 1999, Mr. Tim Bolen (who is referred to as "a media consultant" on the "Dr. Clark Research Association web site) and Mr. Leo Regehr sent a number of e-mail messages to me and various administrators at Ohio State University complaining about the statements on the website. I made them the same offer that I made to Mr. Amrein. I received no information that refutes the comments that are included in my web site. I must assume that no such information exists.

7. In my professional opinion the books by Hulda Clark listed above do not provide competent and reliable scientific evidence in support of the claims listed above. Moreover, in my opinion, apart from Hulda Clark's books, the claims are not supported by competent and reliable scientific evidence anywhere.

a. Hulda Clark's books, listed above, describe her own method of diagnosing and curing all diseases. She claims to have developed her own diagnostic tool, called the Syncrometer, which works on the principle of "resonance" (The Cure for All Diseases, pp 5, 465). The operator of the device must compare two sounds to see if they resonate in order to provide a Yes or No diagnosis Id. p 462) The Syncrometer provides the basis for her entire work. However, there is no scientific basis for the use of the Syncrometer. Its use has not been verified or tested in any scientific manner and the conclusions that Clark reaches from its use (see subparagraph below) are implausible to begin with and contrary to documented research. Assuming that a person actually had a parasitic infestation, there is no scientific reason to believe that this device could detect it, let alone diagnose which parasite was causing the infestation, the lifecycle stage of the parasite or its location within the body, all of which Clark claims to be able to do.

b. As a result of her use of the Syncrometer, Hulda Clark claims that all diseases are

However, her books provide no competent scientific evidence that such combinations of herbs and other dietary supplements are, in fact, effective for this purpose. There is no scientific literature to support the use of herbal remedies in the treatment of flukes, even if these were present. And, as with the Zapper, the premise for using these herbs and other substances is false since the diseases are not caused by parasites. Nor are such claim supported by any body of scientific literature outside of Hulda Clark's books.

f. Hulda Clark uses specific cases to exemplify the success of her unorthodox and unproven methods. But these are also undocumented cases. They are glibly stated without supporting evidence. While there are rare cases of severe disease that show spontaneous regression and improvement, the cases in Clark's books are expounded without proper documentation of the treatment or of the response.

Since 1999, "Tim Bolen" (real name Patrick Timothy Bolen)—who said Hulda Clark hired him as her "publicist"—has distributed false, misleading, and defamatory messages about antiquackery activists through the Internet. Many of these messages have been redistributed by others who welcome what they perceive as convenient opportunities to attack our reputations.

"Tim Bolen," whose real name is Patrick Timothy Bolen, has represented himself as Hulda Clark's "publicist." During the early years of his libel campaign, Bolen and his wife Jan did business as JuriMed, an entity whose stated purpose was to assist "alternative" health practitioners faced with regulatory action, criminal prosecution, or other matters that threaten their financial well-being and/or license to practice. Bolen referred to JuriMed as a "public relations and research group" and to his work as "crisis management." JuriMed's Web site listed no physical address, and I could find no indication of fictitious name registration with the State of California. Bolen sometimes gives his address as 31103 Rancho Viejo #2131, San Juan Capistrano, California, which is a storefront where people rent boxes to receive mail. As far as I can tell, JuriMed never had a telephone directory listing or published street address, although its telephone number was posted on several Web sites. During a deposition in 2006, Bolen stated that he lived and operated JuriMed from a house he leased in the Cleveland National Forest and that he had moved there seven or eight years previously after losing his home in a foreclosure sale . Business use of a National Forest home site is illegal.

In July 2001, New Century Press filed a cross-complaint charging the four of us and about 30 other defendants with committing at least 12 types of crimes and about 20 other civil wrongs. The most serious charge was "racketeering." The defendants included Quackwatch; the National Council Against Health Fraud; several Web site operators who have (justifiably) criticized Hulda Clark's theories and methods; the Internet Service Provider who hosts the healthfraud discussion list; several people who have posted messages to news groups; the woman and her husband who sued Clark for fraud; three people who had filed expert declarations in a case in which the Federal Trade Commission obtained an injunction against a company marketing devices and herbs with claims based on Clark's theories; and "Roes 1-500." Several of the defendants were not legal entities, and at least one did not exist. A few months later, a second nearly identical cross-complaint was filed against me in connection with an unrelated consumer-protection suit in Los Angeles in which I was an expert witness against a company accused of false advertising.

In a book entitled, "The Cure for All Diseases", a woman named Hulda Clark proclaimed that she had found by "research" that "all diseases have simple explanations and cures once their true cause (sic) is known." Clark claims a naturopathic degree and maintains that a rare Asian liver fluke inhabits our bodies and is triggered by "toxins" in the environment to harbor mutant bacteria which cause all of our illnesses--diabetes, high blood pressure, seizures, chronic fatigue syndrome, migraines, Alzheimer's Disease, Parkinson's Disease , multiple sclerosis, and AIDS. While it might be argued that some of these items are "harmless" since they really don't "do anything", I would like to respectfully disagree, and illustrate this point by bringing to the Committee's attention the story of a young woman with cancer who followed the teachings of Hulda Clark "religiously":

After she had finished the chemo and radiation treatments, she started to work again, but shortly ( year) after she was diagnosed with a recurrence of the cancer, which had now spread to her lungs and liver, in spite of what Hulda Clark claims!!

It is problematic when practitioners advance their personal ideas, often disguised as legitimate treatments, upon unsuspecting patients for both real and fanciful illnesses. Beside the unsubstantiated claims and methods promulgated by Hulda Clark, we regularly hear about inappropriate use of hyperbaric oxygen, chelation therapy, and conventional drugs, used for unapproved purposes, for allegedly "treating" "poisonings", arteriosclerosis, and cancer. We also hear about alleged diagnoses made by a litany of pseudo scientific mumbo-jumbo including: applied kinesiology, hair analysis, whole blood analysis, live cell analysis, and other such nonsense. These alleged illnesses are "caused" by environmental "toxins", dental "cavitations", alleged mercury and heavy metal toxicity, NICO, and other made-up conditions. Commonly we also hear of unapproved electrical devices used in both the "diagnosis" and "treatment" of these conditions.

To assist the Mexican Government in closing illegitimate cross-border clinics which offer illegal therapies and treatments, often by unlicensed providers. For example, recent raids in Baja, California closed several illegal clinics, including one run by Hulda Clark, who was mentioned earlier. However, only a small number of operations was included in this sweep. There are many, many more similar "clinics" which appear to have been set up to evade our laws. By closing such operations which often operate on both sides of the border, with mail drops, "800" telephone numbers, and referral services, we have the opportunity to solve problems for us and our neighbor to the south. Similarly, improved collaboration with the Canadian authorities could help put an end to Toronto maildrops and other cross border activities which allow fraudsters to elude regulators and prey on the public of both nations.

I have suspected all along that the entire Figueroa vs. Clark case was manufactured in a basement in Allentown, Pennsylvania by de-licensed MD Stephen Barrett, for the sole purpose of damaging Hulda Clark. Barrett and his minions, bandied this case all over the Internet, using the original unproven accusations to de-fame Clark's books, her followers, and her work. I also suspect that the Plaintiffs, Esther and Jose Figueroa, were recruited into the lawsuit with false statements, and promises, by Barrett and/or his minions.

PAC also promotes the ideas of Hulda Clark and other notorious cancer quacks . A look at their list of some of "over 4,000 books in our library - the world's first Library of Alternative Therapies." can give one a good idea of the hodge podge array of goods they hock. Much of the so-called library is composed of books that arguably have little to do with legitimate science or cancer. And they have some things containing serious misinformation, such as the Hulda Clark garbage with titles like The Cure for All Cancers and the Cure For All Diseases. If one looks to PAC or their library for help in making cancer decisions they will most likely come away more confused than ever. And as far as I know their "library" sells books, it doesn't lend them out like the type of library most are used to.

Confessions of a Former Iridologist, 4/12/2004
I have been asked by many if my rejection of iridology translates into a rejection of all of alternative medicine. I would answer no. Iridology fits into a category of disproved alternative health care practices. These practices have no basis in real anatomy and physiology and have failed well-done trials and studies. Practices that fall into this category include applied kinesiology, reflexology, therapeutic touch, homeopathy, and the Hulda Clark cure for all diseases (zapper, etc.). There are other aspects of alternative medicine that I cannot dismiss without more comment. These may have some scientific support, but are misused or over-used in alternative medicine. Some examples in this category are herbs and supplements. I feel that herbs are actually the same as pharmaceuticals and should be treated with the same respect. I disagree with the motto "I use herbs instead" because herbs act the same way inside the body as their counterparts behind the prescription counter.
